Terms of Use
These Terms form the agreement between you and the operator of Vivid Cinema concerning your use of the service. Please read them carefully.
1. Acceptance
By accessing or using Vivid Cinema, you agree to these Terms and the Privacy Notice. If you do not agree, do not use the service. If you use Vivid on behalf of another person or organisation, you represent that you have authority to accept these Terms for them.
2. The Vivid service
Vivid is a digital entertainment discovery service. Features may include movie and TV discovery, search, recommendations, title information, trailers, personal library tools, live-channel discovery, embedded playback and information about third-party viewing availability. Features, catalogue data and integrations may change.
3. Eligibility
You must be legally capable of entering into these Terms in your jurisdiction. If a feature has an age requirement, you must meet it. Parents and guardians are responsible for supervising minors' use where required by applicable law.
4. Accounts
Where an account is available, you must provide information that is accurate enough for the account to function and keep your credentials confidential. Do not share authentication codes or passwords with us through support channels. Notify us promptly if you believe an account has been compromised.
5. Content and third-party services
Vivid may display metadata, artwork, trailers, channel information or playback experiences supplied by third parties. Third-party services remain under the control of their respective providers and may have separate terms, privacy policies, cookies, advertisements, geographic restrictions and technical requirements. Vivid does not guarantee third-party availability, quality, legality, accuracy or continuity.
6. Streaming and playback
Vivid may present available playback options inside its interface or through embedded third-party technology. Selecting a provider does not transfer ownership of that provider's content to Vivid. Playback may fail because of regional rights, provider outages, network conditions, device limitations, browser restrictions or changes made by the provider.
7. Personal library and local data
Library items, preferences and related information may be stored locally or synchronised to an account depending on the feature. Local browser data can be deleted or lost when storage is cleared. Vivid should not be treated as the sole backup of information you cannot afford to lose.
8. Acceptable use
You may not use Vivid to violate applicable law or another person's rights; interfere with the service; bypass authentication, access controls or security protections; introduce malicious code; conduct unauthorised testing against systems; scrape restricted interfaces in breach of applicable rules; impersonate another person; harvest credentials; or facilitate fraud, abuse or other unlawful activity.
9. Intellectual property
Vivid's original software, interface, branding, design and original editorial materials are protected by applicable law. Third-party films, series, artwork, trademarks, logos, metadata, channel feeds and other materials belong to their respective owners. Except as expressly permitted, these Terms grant you no ownership interest in Vivid or third-party content.
10. Copyright and rights complaints
If you believe material presented through Vivid infringes your copyright or other rights, contact us with enough information to identify the material, your rights, and the basis of the complaint. We may investigate, restrict or remove access to material where appropriate and where we have the ability to do so. We do not claim that every third-party stream or provider is operated by Vivid.
11. Availability and changes
We may add, change, suspend or discontinue features, including third-party integrations, when reasonably necessary for product, security, legal or operational reasons. We will not promise that every title, channel or provider will remain available.
12. Payments and paid features
If Vivid introduces paid products or services, the applicable price, taxes, billing frequency, renewal terms, cancellation rights, refund rules and supplier information will be presented before you are charged. Nothing in these Terms creates a payment obligation merely by browsing the free service.
13. Privacy
Our Privacy Notice explains how personal information is processed. Where Ghanaian law applies, applicable processing is intended to be governed in accordance with the Data Protection Act, 2012 (Act 843) and other applicable privacy requirements.
14. Security
Do not attempt to exploit a vulnerability or access information belonging to another person. Responsible security reports can be submitted through Contact. We may restrict access where necessary to protect users, systems, providers or legal obligations.
15. Disclaimers
Vivid is provided on an evolving basis and, to the maximum extent permitted by applicable law, without a guarantee that it will always be uninterrupted, error-free, complete or available in every territory. Third-party services are outside Vivid's control.
16. Limitation of liability
To the maximum extent permitted by applicable law, Vivid and its operator will not be liable for indirect, incidental, special or consequential losses arising from use of the service or independent third-party services. Nothing in these Terms excludes liability or consumer protection that cannot lawfully be excluded or limited.
17. Suspension and termination
We may suspend or restrict access where reasonably necessary for security, abuse prevention, legal compliance or protection of the service. You may stop using Vivid at any time. Account and personal-data deletion requests are handled under the Privacy Notice and applicable law.
18. Changes to these Terms
We may revise these Terms as the service changes. The effective date will be updated when a new version is published. Where a material change requires additional notice under applicable law, we will provide it through an appropriate channel.
19. Governing law and mandatory rights
These Terms are subject to applicable law. Where Ghanaian law applies, nothing here is intended to remove mandatory consumer, privacy or other statutory protections. Any dispute should first be raised through Contact so the parties have an opportunity to resolve it.
20. Contact
Questions about these Terms, rights complaints, copyright matters, accessibility or security reports can be submitted through Vivid Contact.
